SC will hear the minor’s plea seeking termination of 28-week pregnancy

New Delhi: The Supreme Court will on Monday hear the plea of ​​a 14-year-old alleged rape victim seeking termination of her 28-week pregnancy on Sunday, April 21.

According to the Apex Court’s website, a bench of Chief Justice DY Chandrachud and Justice JB Pardiwala will hear her case as the first issue on Monday, April 22.

On April 19, the top court ordered her medical examination on her mother’s plea, challenging the Bombay High Court’s decision denying termination of pregnancy due to its advanced stage.

A report was sought from Mumbai’s Sion Hospital on the possible physical and psychological condition of the girl if she undergoes medical termination of pregnancy or if she is advised against it.

The court had directed the medical superintendent of the hospital to constitute the medical board and its report would be submitted to the court on April 22, the next hearing.

The counsel appearing before the court on behalf of the petitioner said that the minor is 28 weeks pregnant and currently in Mumbai.

Additional Solicitor General Aishwarya Bhati represented the government in the case.

Under the Medical Termination of Pregnancy Act (MTP), the upper limit for termination of pregnancy is 24 weeks for married women and for women in special categories, including rape survivors and other vulnerable women, such as the disabled and minors.
