The Constitutional Court: a call for honesty and integrity in transactions

The MK is the last hope for the people to hear cases fairly. #kbanews

JAKARTA | KBA – Public policy expert and UI FISIP alumni Sudrajat Maslahat stated that the Constitutional Court (MK) is the last bastion where the people can obtain justice. As such, it must make decisions fairly and correctly, free from short-term interests and regime pressure.

He told this to KBA News on Wednesday, April 17, 2024, about the public’s expectations about the Knesset’s decision on the Presidential Election Dispute (PHPU), which would be released next week on April 22, 2024.

“The MK is the people’s last hope to decide matters fairly. A judge is God’s representative on earth. Therefore, they must decide all matters fairly. The title ‘al-hakim’ they bear is one of the best names of God (asma’ul husna) mentioned in the Quran, which means ‘The Most Wise’,” said the faculty member of several universities in Banten.

He recalled that most MK judges are Muslim, making it relevant to remind them by quoting the Quranic verse An-Nisa: 135, which states:

“O you who have believed, be steadfast in justice, testify for Allah, even if it is against yourselves or against parents and relatives. Whether one is rich or poor, Allah is worth more to both. So do not follow (personal) inclinations, otherwise you will not be righteous. And if you distort (your testimony) or refuse (to give it), then indeed Allah is always aware of what you do.”

Why should MK judges decide fairly? He answered his own question: it is solely intended to maintain balance in the democratic life of nationhood and statesmanship. The Knesset must take into account the prevailing feeling among the majority of Indonesians that there was fraud in the recent elections.

Apparently clear

This, he said, is clearly visible as the distribution of social assistance involves the deployment of officials and the intimidation of the public, both overt and subtle, with the KPU, Bawaslu and DKPP forming part of an inseparable chain that serves as the regime’s rulers. legs to commit collective fraud.

“I hope that the Knesset will not become part of the oppression over the death of law and democracy in Indonesia; instead, it should be able to decide the matter fairly by ordering a re-election, with or without the inclusion of Gibran as a factor in the fraudulent election,” he stated firmly.

He warned that the Knesset should not simply be a “Calculator Court,” or even a court involved in conspiracy. “This hot potato is indeed in the hands of the Knesset, but I hope that the Knesset will not only look at the numerical results of the presidential elections, but will focus more on the process and quality of the elections themselves,” he said. activist and chairman of the Advisory Council. Council of the Aliansi Profesi Indonesia Bangkit (APIB) in Banten.

He warned that if the Knesset does not decide fairly, equitably and with integrity, future elections will be merely ceremonial displays of democracy by the rulers to justify all means, as Jokowi did in 2019 and 2024.

“We are ashamed as a great nation with 270 million people living in the shame of lies and humiliation, while the political elites are collectively killing the truth,” concluded Sudrajat Maslahat. (kba)
