*Complaint filed with CEO Rajasthan, demanding action against Banswara hate speeches of star BJP campaigner Shri Narendra Modi*

*Individual complaint filed for registration of an FIR with Jaipur Police Commissioner Biju George Joseph. The letter was forwarded to the Banswara SP for necessary action*.

The Rajasthan Election Watch and the People’s Union of Civil Liberties (PUCL), late evening on Monday 22NL April 2024 filed a complaint with the Chief Election Officer of the state seeking immediate and strict action against Prime Minister Shri Narendra Modi and several other leaders of the Bharatiya Janata Party (BJP) for delivering a communal hate speech in Banswara, Rajasthan , on April 21, December 2024, and in violation of the Model Code of Conduct and Sections 123(3) and (3A), 125 of the Representation of the People Act, 1951. Kavita Srivastava of the PUCL and Mukesh Goswami of the Rajasthan Election Guard met the CEO OSD , Mr. Suresh Chand, RAS, who received our application.

It was argued that the content of Shri Narendra Modi’s hate speech is not only false but also intended to promote hatred and enmity on grounds of religion and community, disharmony and feelings of enmity, hatred or ill will between different religious groups . and communities. Moreover, the speech was delivered at an election rally to seek votes from the citizens on communal lines.

It also added that the speech clearly concerns acts prejudicial to the maintenance of peace and harmony among various religious groups in Rajasthan and the country as a whole. Similarly, it is also to be noted that Shri Narendra Modi’s speech is a deliberate and malicious act intended to outrage religious sentiments and add insults or attempt to insult the religion and religious beliefs. In a way, Shri Modi’s speech pits the Hindus against the Muslims by calling them ‘infiltrators’.

· Therefore, it was urged that action be taken under the Representation of People’s Act, 1951, against Shri Narendra Modi and the BJP candidates Mahendrajeet Singh Malviya and Dr. Manna Lal Rawat, for the hate speeches delivered at the Vijay Shankhnaad Sabha on April 21. 2024 in Banswara, Rajasthan.

· They also urged that notice of violation be taken under Sections 123(3), 123(3A) and Section 125 of the Representation of the Peoples Act, 1951 and Rules 1 and 3 of the Model Code of Conduct and that strict action including but not limited to disqualification of Shri Narendra Modi and candidates Mahendrajeet Singh Malviya and Dr. Manna Lal Rawat and issuing prohibitory orders against their campaign.

· Criminal action was also sought against the organizers of the Sabha, CP Joshi, the state BJP president and other members of the BJP who were present or involved in the meeting.

File a complaint to register a case against Narendra Modi in Jaipur

Kavita Srivastava and Bhanwar Meghwanshi have filed a complaint in this regard with Jaipur Police Commissioner Biju George Joseph regarding the hate speeches in Banswara on April 21.st by Shri Narendra Modi, star BJP campaigner. The police commissioner showed his reluctance in registering an FIR, arguing that it had no jurisdiction over an alleged crime that had taken place in Banswara. We have insisted that an FIR can be filed with zero number and it was also pointed out that Sections 153 (A), 295 (A) and 505 IPC do not require jurisdiction. However, the Police Commissioner agreed to forward the FIR to the Banswara SP, which happened today (see attached letter).

According to the complaint filed by the two, the Prime Minister campaigned in Banswara for BJP candidates Mahendrajeet Singh Malviya and Dr. Manna Lal Rawat and the contents of his public speech in the Vijay Shankhnaad Sabha there was not only false, but was deliberately created to promote hatred and enmity on grounds of religion. It pitted Hindus against the Muslims by calling the latter ‘infiltrators’ and alleging that the Congress planned to seize the properties and assets of Hindus and distribute them among the Muslims. In his speech, Modi urged the audience by asking them questions like “whether such an act of extorting gold and taking away the mangal sutra from women (Hindu) would be acceptable to them?”. He repeatedly said that he had come to inform them, while in fact implying that he had come to warn them of the dire consequences if his party did not come to power.

The complaint states that the hate speech has been widely disseminated and covered in the media, and that because it has been uttered from the nation’s highest office, it is bound to have serious and lasting consequences beyond influencing the election along divisive and communal lines. It therefore calls for concrete measures to ensure that such attempts are not repeated by any party in the future.

The PUCL and Rajasthan Election Watch will pursue the matter with the ECI and similarly the FIR will also be pursued by the complainants
