The Supreme Court refuses plea for three-year LLB course after Class XII

The Supreme Court today, Monday, April 22, refused to hear a plea seeking an expert committee to explore the possibility of starting a three-year LLB course instead of five after Class XII.

A bench of Chief Justice of India (CJI) DY Chandrachud and Justice JB Pardiwala said they need mature people to enter the profession, and the current five-year course has proven to be very useful, according to a report by ANI.

Since the court was not convinced to consider the plea, the petitioner sought to withdraw the PIL, which was granted. The plea was filed by advocate Ashwini Kumar Upadhyay.

About the petition

According to the petitioner, BTech through the Indian Institutes of Technology (IITs) requires four years of non-redundant education, and that too in a specific field, while BA-LLB or BBA-LLB through the National Law Universities (NLUs) takes five years of life of a student and at the same time provides knowledge of art and commerce, an unrelated and redundant stream. Therefore, a five-year course is irrational, it is reported ANI.

β€œA student may be fine with opting for science in class 12, but it would be difficult and inconvenient for him to study compulsorily during the arts or commerce course. It is a violation of Article 21 because the right to free will is violated. violated,” said the petitioner.

The long and exorbitant course discourages students from studying law. The students prefer to take engineering, civil services or other courses. BA and LLB, or BBA and LLB, are both graduate courses, and thus both are unnecessary in a student’s career.

The annual fee for a five-year course is relatively higher than that of a three-year course, the petition said.

β€œIt denies students from taking a single graduate course after 12th grade. The aim of each course is to provide exactly the essential knowledge required for a student’s career and not to overload a student with all kinds of knowledge as they are countless. BA is in no way essential for studying LLB. It’s certainly good to know, but it’s completely unnecessary,” the petition said.
