The Allahabad High Court dismissed the PIL seeking publication of the Justice Rohini Commission report

The Allahabad High Court has dismissed the Public Interest Litigation (PIL) filed seeking public release of the Justice Rohini Commission report.

The division bench of Chief Justice Arun Bhansali and Justice Vikas Budhwar passed this order while hearing a PIL filed by Eklavya Educational Foundation and Another.

The petition has been filed by the petitioner purportedly in public interest seeking direction to direct respondent No. 1 to publish the report on the recommendation dated 21st July, 2023 of the Justice Rohini Commission and place the same in the public domain in the interests of justice and the greater public interest. .

The Court noted that,

Submissions have been made that the Commission, which was constituted in the year 2017, has released its report in the year 2023 and the said report should be published by the respondents and therefore, a direction can be given in this regard.

The respondents, inter alia, have issued instructions to the effect that the Justice Rohini Commission was constituted under Article 340 of the Constitution with the approval of the President of India on October 2, 2017.

The Commissioner submitted his report to the President on 31 July 2023 in terms of Article 340(2) of the Constitution and in terms of Article 340(3) the report, together with the actions taken thereon, must be submitted to both Houses of the Constitution. Parliament and until the process is completed as prescribed, the report cannot be placed in the public domain.

“In view of the above instructions of the respondents, which are in accordance with the provisions of Article 340 of the Constitution of India, no case is framed in the Public Interest Litigation,” the Court observed while dismissing the petition.
