Kano court bars police from arresting APC branch executives over ‘suspension’ of Ganduje

A Kano State High Court has issued an exparte order restraining the Inspector General of Police (IGP), the Assistant Inspector General (AIG) Zone 1 Kano and the Commissioner of Police Kano from inviting, arresting or to bother. Recall that the officers of Ganduje District suspended the National Chairman of the APC, Abdullahi Ganduje, which was subsequently quashed by the state working committee of the party.

The community police officers subsequently took legal action demanding judicial confirmation of Ganduje’s suspension, which led to the security officers reportedly searching for the community police officers.

Justice Yusuf Ubale Muhammad, in the exparte order granted on May 2, 2024, however, restrained the APC National Working Committee (NWC), Kano State Working Committee and Ganduje from using security agents to arrest or detain the ward officials, pending of the hearing. and determination of the motion by notice.

The exparte motion was filed by Jafar Adamu, Haladu Gwanjo, Laminu Sani Barguma and ten other faction officials, through their counsel, Shamsu Ubale Jibrin Esq, with the applicants seeking protection of their fundamental human rights as guaranteed by the Constitution.

The motion was supported by two affidavits, the first sworn by applicant Jafar Adamu (Suit No. K/M759/2024) and the second sworn by applicants Haladu Gwanjo and Laminu Sani Barguma (Suit No. K/M758/2024).

The applicants are challenging the IGP, AIG Zone 1 Kano, Commissioner of Police Kano, APC, APC NWC, Kano APC State Council and Ganduje himself.

“And after hearing Shamsu Ubale Jibrin Esq. of counsel for the two groups of applicants today, May 2, 2024, is hereby ordered as follows.

“A preliminary injunction is hereby issued restraining the defendants in the two consolidated suits, their officers, agents, secrets or any other officer serving under them from inviting, arresting, harassing or detaining the applicants with relating to the subject of the case. pending the hearing and decision on the request based on a notice already submitted.

“It is further ordered that an interim order for the motion to dismiss and all other proceedings in this action be served on all respondents in a timely manner and prior to the next adjourned date. The matter has been adjourned until June 5, 2024, so that the motion can be heard on notice,” the motion reads.

The case adds another layer of complexity to the political dynamics within Kano State and the APC.
